Terms & Conditions

These Terms & Conditions apply to all bookings with “Davinder Ojalla/MedYogaSchool.com” for retreats, events, coaching, counselling, therapy, products, services, classes and workshops in Spain, Italy, UK, Ireland and elsewhere if applicable and for one-to-ones held either in person anywhere in the world or via a remote link, such as Skype.

 

Your contract is with “Davinder Ojalla/medyogaschool.com"


Your relationship with “Davinder Ojalla” and “The Venues” (or “The Venue”)

“The Venues” refers to any of The Venues used or any venues in the U.K. (or elsewhere) hosting my Retreats”. The course element (i.e. the teaching provided during sessions at “The Venues”) is provided by “Davinder Ojalla/medyogaschool.com. But all hotel elements (and all hospitality elements for day venues) are provided by “The Venues”. You therefore have a direct relationship with “The Venues” for all matters concerning the hotel (or venue structure, where applicable): e.g. accommodation, food, facilities, transfers, etc.. “Davinder Ojalla/medyogaschool.com” is not responsible for any such elements.

“Divinedavinder.com” Retreats” has clearly researched “The Venues” and has been in discussion with them, and is providing information on the website: www.medyogaschool.com in good faith based on that research and discussion. It is not, however, responsible for inaccuracies in information regarding “The Venues” or for any problems arising from “The Venues ”’ provision of facilities or services.

Exemption from liability in case of unforeseen events.

​

“Davinder Ojalla/medyogaschool.com” is not liable for adverse weather conditions, strikes, transport delays or technical problems or any other unpredictable or unforeseeable event which could prevent you from participating in the holiday or event or one-to-one, whether in person or virtually.

​

It is strongly recommended that you have adequate travel insurance to cover any possible problems that may occur during your holiday or event; particularly relating to emergencies that could involve a visit to hospital casualty, and admittance to hospital.

​

Exemption from liability for health problems.

​

“Davinder Ojalla/medyogaschool.com”  does not offer medical advice or opinions, and cannot in any case substitute an appropriate assessment by your personal physician, whom ourselves invite you to consult if you have any doubts about your ability to participate in holistic disciplines, whether in person or virtually, such as in a virtual one-to-one session.

It is your responsibility to inform ourselves of any health conditions which could prevent, limit or in any way affect your participation in any of the activities.

If you have any issues that relate to the ‘hotel’ side provided by “The Venues” (such as mobility), then please contact “The Venues” directly if you believe they require advance notice of such issues.

​

All therapies, products, recipes, detox programs & retreats offered are holistic suggestions that may improve health. The client takes full responsibility for ensuring he/she has taken relevant advice from a GP before embarking on any of our programs or consuming our products.

​

Your decision to consume, partake on any of our services or consume our goods is your sole responsibility to use with care & your sole liability to ensure all products, supplements, foods, recipes, exercises, tools & techniques are taken or performed at your own risk.

​

All items should be tested in case of allergic reactions & any recipes or content provided from blogs are suggestions only & do not in any way override the guidance of medical practitioners.

​

We advise you test all products or superfoods individually in case of reaction or allergies prior to following any of our recipe suggestions. We in no way claim to be food or nutritional experts.

​

The guest takes full and exclusive responsibility when doing any activities during sessions. In no case, is “Davinder Ojalla/medyogaschool.com” or their operators liable for any damage, direct or indirect, to your health.

Informed Consent for Participation

​

It is important to understand the nature of the holistic activities you are participating in prior to registration and booking. Information about the nature of the course and activities is contained in the description for that particular course or activity on the website (or elsewhere on the site if referring to one-to-ones). If you are unfamiliar with any of the references or concepts conveyed in these descriptions, then please research their background. If you are still in doubt, ask the organisers before registration.

In general, you will be participating in holistic and therapeutic activities as part of your holistic course, class or Retreat or other events or one-to-one sessions. These activities may include (but are not limited to) the following: meditation, relaxation exercises, breathwork, mindfulness exercises, energy work (such as ‘Qigong’), sharing work (where you share your feelings with the group), gentle physical movement, voice dialogue, somatic experience exercises, reiki, therapeutic written exercises (such as diary entries to understand your state of mind), therapeutic partner exercises (such as sharing how you feel with a partner, or offering healing in the form of gentle physical touch), movement and expression exercises, healing sound exercises, detoxing, cleansing, raw food, superfoods, holistic beauty and so on.

You therefore participate in the holistic course, event or one-to-one fully aware of their therapeutic content. A simple exercise, like meditation, can be mentally activating, as well as calming. Simple physical movements can be physically activating, as well as calming. Holistic activities do create physical, mental and emotional effects.

​

You participate in the holistic exercises aware that they may well be physically, emotionally and psychologically challenging. If, having informed yourself of the nature of these holistic activities, you think you may have a physical or psychological condition, or suspect you may have one, that may be exacerbated by the exercises, then do consult a medical doctor or psychiatrist before booking, and certainly before attending.

​

In any event, if you attend the course, event or one-to-one and thus participate in the holistic activities, it is incumbent on you to judge exercise by exercise whether you are comfortable with them, and capable of doing them. If you at any time feel uncomfortable, either physically or psychologically, with any exercise, then either refrain from doing it, or stop doing it if you have already started. If you feel uncomfortable with doing a partner exercise, that might involve verbal sharing or physical touch, then either refrain from doing it, or stop doing it if you have already started.

​

The holistic activities are powerful. That is why people participate in these courses, events or one-to-ones: they are therapeutic. And it is important that you understand the potential power of these exercises before you register for participation.

​

Your agreeing to these terms and conditions, and your subsequent participation in the courses, events or one-to-ones and their holistic activities, demonstrates your informed consent to these course and activities.

​

Theft and loss of property

​

Davinder Ojalla/medyogaschool.com recommends that you do not bring jewellery or valuable items with you during your stay. If you do, please do not wear jewellery or objects of value during the holistic activities. “Davinder Ojalla/medyogaschool.com” is not liable for theft, or for any loss of your personal property, under any circumstances.

​

Payments

​

For classes, day events, workshops & weekend events refunds will not be given under any circumstance once payment has been made.

​

For yoga holidays, retreats & transformational packages across UK, USA, France, Spain, Italy or others please note the following:

Under no circumstance do we offer refunds on payment of a deposit for any retreats or workshops.

Full payment is due 3mths prior to arrival date. If full payment has been made & with a minimum of 2mths notice prior to arrival date, we may consider returning “x” amount as a good will gesture if we can recoup our costs for emergency cancellations. We require a written cancellation to apply for a reimbursement & must be deemed acceptable/an emergency.

Flights, Transfers and other information

​

“Davinder Ojalla/medyogaschool.com" seeks to provide solutions in reference to Yoga Holidays & Retreats for the provision of booking transport, flights & transfers. It is solely your responsibility to ensure your bookings are managed in our time frames.

​

Your transport, flights & transfers are not part of the contract with ourselves & under no circumstance do we take responsibility for transport, transfers or flight cancellations or bookings.

​

We strongly advise not booking flights & transfers until you have been authorised by ourselves. Booking these prior to completion & return of our full forms & terms is the sole responsibility of yourselves.

​

We do not advise booking your travel until authorised by ourselves in the unlikely event of event cancellation. We take no responsibility for the refund of any travel costs you may incur on booking this retreat or changes that may occur.

 

Cancellation

​

In the unlikely event that your event, workshop, holiday or one-to-one with “Davinder Ojalla/medyogaschool.com” at one of “The Venues” (or virtually) should be cancelled, we will endeavour to offer you availability at an alternative time; or, if you prefer reimburse what you have already paid directly to “Davinder Ojalla/Divinedavinder.com” in full.

​

Jurisdiction

​

For any dispute that could arise in relation to the interpretation, execution and/or cancellation of the booking contract, to which these conditions are applicable, and in which “Davinder Ojalla/medyogaschool.com” is legally involved, the Courts of England shall have sole jurisdiction.

​

My service is in no way to be construed or substituted as psychological counselling or any other type of therapy or medical advice. I will at all times exercise my best professional efforts, skills and care. However, I cannot guarantee the outcome of counselling & coaching efforts and/or recommendations on my website/blog/email series and my comments about the outcome are expressions of opinion only. I cannot make any guarantees other than to deliver the services purchased as described.

Consent

Your consent is given on purchase of any product, service or therapy program. By giving your consent you are also giving consent on behalf of anyone else you are buying/booking for (whether partner, friend/s or other/s). Therefore, whoever gives this consent must have been authorized to give it by the other participant / participants.
